Terms of Service

1. Acceptance of Terms

By accessing or using Meadley Bros. (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. You must be at least 18 years old and have the authority to enter into contracts on behalf of yourself or your business to use the Service.

The Service is operated by My Lead Hawk, LLC, a North Carolina limited liability company doing business under the Meadley Bros. brand.

2. What We Provide

Meadley Bros. is a platform that allows users to:

• Build filtered property address lists from publicly available data, satellite imagery, and third-party property data providers
• Download an Excel mailing list and a printer mailing CSV
• Design postcards using our online editor and templates with photos you upload
• Export print-ready postcard files to have printed and mailed by a third-party printer of your choice (for example Vistaprint)

Lists and designs may be purchased one at a time, and we also offer optional Monthly and Annual memberships described in Section 7.

3. Account Registration

You may create an account using email and password, or through third-party sign-in providers (Google, Apple, Facebook). You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. If you suspect unauthorized access, use the verified contact method published on our Contact page.

If you sign in through a third-party provider, your use of that provider is governed by that provider's terms and privacy policy. If you revoke our access through your third-party provider, you may lose the ability to log in.

4. Permitted Use of Purchased Lists

You may use purchased lists for lawful direct marketing of your own services: mailing to the addresses in the list, and uploading the list to an advertising platform as a matched audience for your own ads where that platform's terms permit it. The Excel workbook is provided for reviewing and editing the purchased mailing destinations; the mailing CSV is provided for use with the third-party printer or advertising platform of your choice. Uploading a list to a platform that acts only as your service provider for the match is not sharing it with a third party under these Terms.

You are responsible for following applicable laws and each printer's data, formatting, and mailing requirements. Meadley Bros. does not guarantee postal deliverability or acceptance by a printer.

You may not:

• Resell, redistribute, sublicense, or share lists with any third party, other than a printer or advertising platform acting as your service provider
• Use lists for harassment, stalking, doxing, or any unlawful purpose
• Use lists for fraudulent, deceptive, or misleading communications
• Use lists to promote illegal goods or services
• Combine lists with other data sources to create profiles of individuals beyond what's necessary for direct marketing
• Use lists for political campaigning, fundraising, or advocacy purposes without disclosing this intent at purchase

Violation of this section may result in account termination and legal action.

5. User-Uploaded Content

When you upload photos, logos, designs, business information, or other content to the Service ("User Content"), you represent and warrant that:

• You own or have all necessary rights, licenses, and permissions to use the User Content
• Your User Content does not infringe on any third party's copyright, trademark, publicity rights, privacy rights, or other intellectual property rights
• Your User Content is not defamatory, obscene, harmful to minors, or otherwise unlawful
• You have obtained consent from any identifiable individuals depicted in your User Content

You grant Meadley Bros. a limited, non-exclusive, royalty-free license to store, display, modify (for formatting and sizing purposes), and transmit your User Content solely for the purpose of providing the Service to you and fulfilling your orders. This license terminates when you delete the content or close your account, except where retention is required for legal or operational purposes (e.g., completed orders).

Meadley Bros. does not monitor or pre-screen User Content, but we reserve the right to remove any content that violates these Terms at our discretion.

6. DMCA and Intellectual Property Complaints

If you believe that User Content on our Service infringes your copyright, use the verified contact method published on our Contact page and include the following information:

• Your contact information
• A description of the copyrighted work you claim has been infringed
• A description of the material you claim is infringing and its location on the Service
• A statement that you have a good-faith belief the use is not authorized
• A statement, under penalty of perjury, that the information is accurate and you are authorized to act on behalf of the copyright owner
• Your physical or electronic signature

We will respond to valid DMCA notices in accordance with US copyright law.

7. Payments and Pricing

All prices are listed in United States Dollars (USD). Payment is processed through Stripe, Inc. You authorize us to charge your designated payment method for all purchases. We reserve the right to change pricing at any time. Completed purchases are charged at the price displayed at the time of checkout. Prices do not include applicable taxes, which you are responsible for paying.

Membership. Membership is optional and billed through Stripe. The Monthly plan renews automatically every month and the Annual plan renews automatically every year, each at the price shown when you joined, until you turn renewal off. Before you start an Annual plan you agree separately to its renewal terms, which name the amount, the first renewal date, and how to turn renewal off; we email you a copy when the plan starts and again 30 days before each renewal. You can turn off renewal at any time from Profile and billing in your dashboard with one click; turning it off stops the next charge and your membership benefits continue through the end of the period you have paid for. If we change the price or the renewal terms, we will tell you before the change takes effect and you may turn renewal off. Membership fees already paid are not refunded. List purchases made at member pricing remain yours after renewal ends.

8. Third-Party Printing and Mailing

Our Service provides postcard design tools and print-ready files only. Printing and mailing are performed by third-party printers that you choose and pay directly (for example Vistaprint). If you send our print-ready files to a printer, you acknowledge that:

• Your agreement for printing and mailing is with that printer, not with us; their delivery times and quality are outside our control
• USPS delivery times are outside our control
• Design approval is your responsibility before submission to print; we are not liable for errors in content, spelling, images, or addresses that you approved
• Once a job is submitted to a printer, changes, cancellations, and refunds are governed by that printer's policies

9. No Guarantee of Accuracy

Data is sourced from public records and third-party providers. While we strive for accuracy, we do not guarantee that every address is current, deliverable, or that property details (acreage, assessed value, square footage, land cover data) are error-free. Satellite-derived data reflects our best interpretation of imagery but may not match on-site conditions. Purchased lists and property data are provided "AS IS" without warranty of any kind.

Data sources & attribution. Property and land-cover data is derived from public and openly licensed sources. Public-domain sources include the U.S. Geological Survey and the Multi-Resolution Land Characteristics Consortium (the National Land Cover Database, 3DEP elevation, and the National Hydrography Dataset) and the U.S. Department of Agriculture (NAIP imagery). Tree canopy height data is © Meta and the World Resources Institute, made available under the Creative Commons Attribution 4.0 (CC BY 4.0) license. Certain property attributes are sourced from licensed third-party data providers. You are responsible for using any list in compliance with applicable marketing, mail, telemarketing, and privacy laws.

10. Refund Policy

Because digital address lists are prepared immediately after payment, list sales are final and nonrefundable. If a technical issue prevents delivery, use the verified contact method on our Contact page within 48 hours and we will restore or resend the file.

11. Intellectual Property

The Meadley Bros. name, logo, property-intelligence branding, website design, filtering algorithms, templates, and proprietary data layers are the intellectual property of Meadley Bros. Purchasing a list, designing a postcard, or otherwise using the Service does not grant you any rights to our brand, technology, or platform beyond the limited license to use the Service as described in these Terms.

12. Prohibited Conduct

You may not:

• Reverse engineer, decompile, or attempt to extract the source code of the Service
• Scrape, spider, or automate access to the Service without written permission
• Use the Service to compete with Meadley Bros. (e.g., reselling our data or imitating our platform)
• Attempt to access accounts or data that do not belong to you
• Interfere with or disrupt the Service
• Use the Service in violation of any law

13. Limitation of Liability

To the maximum extent permitted by law, Meadley Bros., its affiliates, officers, employees, and agents are not liable for any indirect, incidental, consequential, special, or punitive damages arising from or related to your use of the Service, including but not limited to:

• Undeliverable mail or returned mail
• Inaccurate property or address data
• Marketing campaign results or lack thereof
• Third-party actions (payment processor, print vendor, mail carrier, OAuth provider)
• Data loss or service downtime
• User Content uploaded by you or other users

Our total liability for any claim arising from the Service is limited to the amount you paid Meadley Bros. in the twelve months preceding the claim, or $100, whichever is greater.

14. Indemnification

You agree to indemnify, defend, and hold harmless Meadley Bros. and its affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney fees) arising from:

• Your use of purchased lists or the Service
• Your User Content, including any claims of copyright, trademark, or privacy infringement
• Your violation of these Terms
• Your violation of any law or regulation
• Your violation of the rights of any third party

15. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms, fraudulent activity, or at our discretion. Upon termination, your right to use the Service ceases immediately, but provisions that should reasonably survive termination (including payment obligations, intellectual property, limitation of liability, and indemnification) will survive.

16. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Service shall be resolved in the state or federal courts located in North Carolina, and you consent to the jurisdiction of those courts.

17. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you by email or through a notice on the Service. Changes take effect 30 days after posting unless you object by discontinuing use of the Service. Your continued use after the effective date constitutes acceptance.

18. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

19. Entire Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and Meadley Bros. regarding the Service.
